Terms of Service

By accessing or using the services provided at commentkro.in (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you") and Comment Kro Technologies Pvt. Ltd. ("Company", "we", "us", "our"), a company incorporated under the laws of India.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or a prominent notice on the Platform. Your continued use of the Platform after any modification constitutes acceptance of the revised Terms.

Comment Kro provides an Instagram and Facebook comment automation platform that enables users to:

• Automatically send direct messages (DMs) to users who comment specific keywords on Instagram posts, reels, and stories.
• Create and manage automation workflows linking comment triggers to DM templates.
• View analytics, contacts, and engagement data related to their automations.
• Connect their Meta (Instagram/Facebook) business accounts via OAuth 2.0.

The Platform operates as a Meta-authorized third-party tool and complies with Meta's Platform Policies and Graph API terms. We do not guarantee uninterrupted access to Meta's services, as they are subject to Meta's own terms and technical availability.

You agree NOT to use the Platform to:

• Send spam, unsolicited messages, or bulk promotional content not consented to by recipients.
• Harass, abuse, threaten, or impersonate other users or individuals.
• Violate any applicable law, regulation, or third-party right, including Meta's Community Standards and Platform Policies.
• Distribute malware, viruses, or any harmful code.
• Scrape, crawl, or harvest data from the Platform without express written permission.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Platform.
• Use the Platform for any illegal or unauthorised purpose, including circumventing Instagram's rate limits or anti-spam measures.
• Engage in any activity that manipulates engagement metrics in a manner that violates Meta's Inauthentic Behaviour Policy.

Violation of these prohibitions may result in immediate suspension or termination of your account without refund, and may expose you to legal liability.

Our Platform integrates with Meta's Instagram and Facebook APIs. As a condition of using our services, you acknowledge and agree that:

• You must comply with Meta's Platform Policy and all applicable Meta Community Standards at all times.
• Your use of Instagram/Facebook features through our Platform is also governed by Meta's Terms of Service.
• We are not responsible for changes to Meta's APIs or policies that affect the functionality of our Platform.
• Meta may revoke your account's access to their platform independently of any action we take.
• You grant us permission to access, use, and transmit your Instagram/Facebook account data solely to provide the services described herein.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure at all times.
• Results obtained through the Platform will meet your expectations or business goals.
• Any defects or errors in the Platform will be corrected within a specific timeframe.

Your use of the Platform is at your sole risk. We are not liable for the actions of Meta, Instagram, or Facebook in relation to your account or any data processed through their APIs.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMMENT KRO TECHNOLOGIES PVT. LTD., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR LICENSORS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, goodwill, business interruption, or other intangible losses.
• Any damages arising from your use of or inability to use the Platform.

In no event shall our total aggregate liability to you exceed the greater of (a) the total amount paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) INR 1,000 (Indian Rupees One Thousand).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

Either party may terminate the agreement under these Terms at any time.

• By You: You may cancel your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.
• By Us: We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms, violate Meta's policies, or if we determine that your use poses a risk to the Platform, other users, or our legal compliance.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, it shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with proceedings conducted in English in India.

Nothing herein prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
